1. General
1.1 This website forms part of the AOGA's campaign to support the St Mary's School Performing Arts Centre Appeal. Notwithstanding this general purpose, except where stated otherwise, St Mary's School, its officers and employees shall not be liable for any claims whatsoever arising in relation to this website including, but not limited to, donations made via this website, events advertised on this website, matters arising in relation to the shop and auction pages of this website and matters arising in relation to any links featured on this website
1.2 Certain areas of this website are accessible by registration only. To qualify for registration persons wishing to register must be: -
1.2.1 a current or former pupil of St Mary's School
1.2.2 or a relation of a current or former pupil of St Mary's School
1.3 This website is provided for personal use only and may not be used for any commercial purpose

2. Donations / Payments
2.1 All payments made on this website using the secure online payment server, Protx, will be paid into the St Mary's School Ascot Development Fund account at Lloyds TSB plc, Ascot Branch
2.2 Donations (and, where applicable, payments) can also be made by sending a cheque made payable to 'The St Mary's School Ascot Development Fund' to The Development Office, St Mary's School Ascot, St Mary's Road, Ascot, Berkshire SL5 9JF

3. Events
3.1 The AOGA and the members of the committee of the AOGA ("the Committee") shall not be liable for any claims whatsoever arising from any events advertised on this website except where such events are organised directly by the Committee

4. Shop
4.1 Great care has been taken in presenting the products on this website as accurately as possible. This notwithstanding the AOGA and the Committee cannot guarantee that the product images you see are an accurate representation of the actual merchandise
4.2 All items listed for sale in this website's shop remain in the ownership of the seller until completion of the sale regardless of whether the proceeds of sale will be retained by the seller or donated to the appeal
4.3 Sellers must pay a monthly fee of £5.00 to list one or more items on this website's shop. For the avoidance of doubt, this monthly fee is payable per seller regardless of how many items that seller wishes to list for sale. The payment of this monthly fee can either be made using this website's secure online payment server or by cheque. For further details please refer to point 2 above
4.4 A prospective purchaser submitting a purchase order through this website will be put in direct touch with the seller by the AOGA acting as facilitator. All further matters relating to the sale of the item including, but not limited to, the time and manner of payment, the time and manner of delivery and the transfer of ownership, will be a matter for negotiation between the seller and the purchaser. For the avoidance of doubt, the AOGA: -
4.4.1 is acting in this matter as facilitator only to provide the seller and the purchaser with the opportunity to use the shop on this website;
4.4.2 is not a direct or indirect party to the contract of purchase and sale between the seller and the purchaser;
4.4.3 has no control over, does not guarantee and shall not be held responsible for: -
4.4.3.1 the quality, safety or legality of items listed;
4.4.3.2 the truth or accuracy of listings;
4.4.3.3 the ability of sellers to sell items;
4.4.3.4 the ability of purchasers to pay for items; or
4.4.3.5 whether a purchaser or seller will actually complete a transaction
4.5 Returns and refunds cannot be made in relation to items listed in this website's shop unless: -
4.5.1 expressly stated by the seller to the purchaser at the point of purchase; or
4.5.2 required by law

5. Auctions
5.1 Great care has been taken in presenting the auction lots on this website as accurately as possible. This notwithstanding the AOGA and the Committee cannot guarantee that the auction lot images and descriptions you see are an accurate representation of the actual lot
5.2 Any bid made via this website constitutes a legal offer to buy the item from the AOGA. Any retraction of a bid can only be made by agreement with the AOGA
5.3 The AOGA is entitled to set minimum bids or reserve requirements and is entitled to change these during the auction period. If an auction subject to a reserve ends and the reserve price is not met the highest bidder and the AOGA are released from any obligation to complete the transaction
5.4 The winning bid in any auction will be the first highest bid that exceeds the reserve price (if any) at the end of the stated auction period
5.5 Within 3 working days of the end of the stated auction period the winning bidder will be notified by the AOGA by email ("notification"). The placement of the winning bid together with notification constitutes a legally binding contract to buy the item
5.6 Payment for the item must be made within 7 days of notification. Payment will be deemed to have been made when the relevant funds have been transferred to the St Mary's Ascot Development Fund account via Protx or when a cheque for the relevant amount has been received by the St Mary's Ascot Development Office
5.7 If payment is not made within 7 days of notification, the AOGA will be entitled at its discretion to offer the item to the next highest bidder or to re-auction the item
5.8 The amount of any successful bid will be exclusive of delivery or collection costs
5.9 The winning bidder will be informed of details relating to the delivery or collection of items upon notification. Unless expressly agreed otherwise with the AOGA, where an item is to be collected by the winning bidder, collection must be made within 14 days of notification at which time risk of ownership will pass to the winning bidder

6.1 The payment for the purchase of a link can either be made using this website's secure online payment server or by cheque. For further details please refer to point 2 above
6.2 Links will remain on this website until Easter 2008 or until such earlier time as requested by the owner of the link website
6.3 Whilst great care has been taken to vet link websites in as far as possible, the AOGA and the Committee are in no way responsible for the content of any such websites and any views expressed on such websites should not be taken as the views of the AOGA or the Committee
